Many child custody disputes are complicated and highly emotional. This is especially true if one parent has accused the other of committing or threatening violence against a family member. When this occurs, judges have been put in a difficult position. They want to respect a parent’s right to spend time with their son or daughter while keeping the child safe from any danger that parent might pose. Unfortunately, some decisions granting unsupervised visitation have led to tragic consequences, and now a new Pennsylvania law has been passed to ensure that children’s safety is the paramount concern in custody matters. 

The legislation known as Kayden's Law is named after Kayden Mancuso, a young girl killed by her father during a court-ordered unsupervised visit. This statute aims to protect children in numerous ways, such as:

  • Greater weight to safety concerns — The core principle of Kayden's Law is to elevate the importance of child safety in custody decisions. This means that judges will be required to give greater weight to evidence of abuse, neglect or violence when determining custody arrangements.

  • Clearer guidelines for evaluating abuse allegations — Rather than giving the judge complete discretion in deciding how to evaluate abuse allegations, the law includes a requirement for an evidentiary hearing when such allegations arise. 

  • Enhanced training to help court personnel assess risks — Kayden's Law establishes mandatory training for judges, attorneys and other court personnel on issues related to child abuse and domestic violence.

  • Expanded definition of abuse — Provisions in the law expand the definition of abuse to include a broader range of harmful behaviors.

Kayden's Law should have a profound impact on child custody cases in Pennsylvania, shifting the focus of custody decisions more squarely onto the safety and well-being of children, rather than simply on parental rights.  

Opponents of the law argued that it could unfairly disadvantage parents who are falsely accused of abuse or who have a history of minor offenses. Additionally, there are concerns about the potential impact on parental rights and the complexity of implementing the law's provisions.
